This issue in practice causes numerous geodetic and legal problems and prolongs the investment. Due to the necessity of the acceleration of the development of road infrastructure, new legal regulations were introduced, including acquiring the land for the road construction. Wydział Geodezji Górniczej i Inżynierii ŚrodowiskaItem type:Article, Access status: Open Access , Analysis of changes in procedure of designating agricultural and forest lands for investment purposes(2010) Kwartnik-Pruc, Anita; Szafarczyk, Anna; Trembecka, AnnaThe possibility of utilization of agricultural and forest lands for the investment purposes is associated both with the change in their purpose, as set forth in a local development plan, as well as with administrative proceedings which would allow their actual exclusion from production. The Agricultural and Forest Land Protection Act, amended at the end of 2008, liberated the hitherto regulations by excluding agricultural lands utilized as crop lands and located within the cities corporate limits from the regulations of this act. At the same time, the necessity to obtain permission of higher competent authorities to designate land for investment purposes in the local development plan was limited. The article presents: the authorities who grant their approval to alter the purpose of the land in a local plan, the changes in the scope crop land types requiring a decision on exclusion, as well as the changes in competences of the authorities and the possibilities of reducing fees for exclusion of lands from agricultural production and forestry over the past 15 years.Item type:Article, Access status: Open Access , Analysis of possible cases of acquisitive prescription of public properties presented on example of selected area(Wydawnictwa AGH, 2019) Trembecka, AnnaThe main purpose of this research paper is to analyze the conditions, extent, and reasonable grounds for the acquisitive prescription of public real properties (i.e., those owned by the state treasury and local government units), taking into account the exclusion time for public properties to be subject to the possibility of prescription. The acquisitive prescription of real properties is one of the methods used to regulate the legal status and for the owner to obtain a title of ownership for the property.The analysis was carried out on the example of the city of Krakow. This allowed me to assess the causes and effects as well as the scale of the practical implementation of this legal institution. The final results of the performed research study are proposed actions that should be taken as part of the public property management process aimed at protecting ownership rights by means of stopping the course of acquisitive prescription. The results of the research studies have proven the legitimacy of introducing legal regulations limiting the possibility of the acquisitive prescription of public properties.A comparison of the reasonable grounds and dates of the acquisitive prescription of the real properties in Poland with those in force in other countries (such as the United Kingdom and Germany) was also performed.Item type:Article, Access status: Open Access , Analysis of the process of real estate disposal by public tender and related legal and surveying actions on the example of the City of Krakow(2014) Trembecka, AnnaAn important part of the City of Krakow budget revenue are the proceeds from the sale of properties by way of a public tender. This mode is a primary manner of disposal of public property which ensures transparency of the proceedings and open access for the participants. This paper analyzes the stages of the tender procedure, the type and number of the properties sold by the city of Krakow in the last three years, as well as the revenue from such activities. Also, surveying and legal actions were proposed which, in the opinion of the author, are required to be carried out before the commencement of the tender procedure. It will allow us to eliminate the problems which prevent the notarial deed from being executed with the successful tenderer, as well as to limit damage claims directed to public entities. Asking prices in the tender shall be established based on the values of properties specified in the appraisal studies executed by certified appraisers. Z tego powodu autorki zdecydowały się przedstawić pełny katalog możliwości uzyskania praw do cudzej nieruchomości w celu posadowienia urządzeń przesyłowych, z uwzględnieniem wprowadzonej z dniem 3 sierpnia 2008 r. służebności przesyłu. W artykule przedstawione zostały również czynności geodezyjne przy ustanawianiu tej służebności.
