It records information related to the division of land into types based on the actual way of land use or development. The distinguished types of land use depend on many geographical factors, as well as historical and economic conditions. The study presents a comparison of the detail of land use classification registered in the real estate cadastre in areas functionally related to the urban areas of 9 European countries: Austria, Bulgaria, the Czech Republic, Estonia, Spain, Lithuania, Luxembourg, Germany and Poland. The research concerned the determination of the degree to which the classification of land use in urbanized areas is detailed, whether the studied European countries are characterized by the same number of distinguished classes of ob jects at different levels of detail, and what percentage are the distinguished classes of land use objects in urbanized areas in relation to all of the distinguished classes of objects land use at different levels of detail of classification. The study used legal acts regulating land use issues which have been made available in national languages by government institutions.Item type:Article, Access status: Open Access , Application of cadastral data in the land acquisition process for flood control investments(2012) Konieczna, Jadwiga; Trystuła, AgnieszkaCadastre is a basic land information system based on registered plots and containing three basic elements making a foundation of proper land administration in every state: ownership, value and method of use. Modern cadastre serves the needs of the owner and society as regards to spatial and economic planning, establishing tax and benefits, public statistics and designation of real estate properties in land and mortgage registers. On July 2010, the Act on Specific Principles of Preparing Investments concerning Flood Protection Structures (e.g. bypass channels, impounding reservoirs and flood banks) was passed in Poland. This undertaking is one of many measures aimed at preventing tragic results of floods, which have been recently affecting Poland increasingly often. The effective Act simplifies the expropriation procedure related to real estate proprieties, e.g. for the construction of flood banks. The investment can be commenced immediately after a decision approving its implementation is issued. The aim of the study is to present the important role of the cadastre in the process of land acquisition for hydro-technical investments, mainly at the stage of preparing a decision approving the implementation of an investment concerning flood protection structures.Item type:Article, Access status: Open Access , Application of transformation with conditions within process of boundaries determination(2007) Hanus, PawełJedna z metod wykorzystania mapy katastralnej do ustalenia przebiegu granic nieruchomości polega na jej zeskanowaniu, a następnie zastosowaniu właściwej transformacji, która dopasowuje mapę do układu terenowego. Proces skanowania polega na przetworzeniu klasycznej mapy papierowej do postaci cyfrowej - rastra. Jednakże raster, niepoddany dalej żadnemu przetworzeniu jest jedynie 'obrazkiem' nieposiadającym ani określonych współrzędnych w żadnym układzie ani też cech geometrycznych niezbędnych do jej zastosowania, w różnych zagadnieniach geodezyjnych związanych z granicami działek. Aby taki raster prawidłowo wykorzystać, należy najpierw dokonać procesu jego wektoryzacji. Proces wektoryzacji jest wykonywany po transformacji rastra do terenowego układu współrzędnych na podstawie punktów dostosowania. Należy zaznaczyć, że odpowiednio dobrana transformacja oraz odpowiednio wybrane punkty dostosowania, umożliwiają zminimalizowanie lub nawet całkowite zlikwidowanie prawie wszystkich błędów, którymi obarczona jest mapa. Jednak należy też zaznaczyć, że niewłaściwie wykonana transformacja może doprowadzić z kolei do zwiększenia tychże błędów. Do ustalenia granic nieruchomości na podstawie mapy katastralnej bardzo przydatna okazuje się transformacja z warunkami nałożonymi na punkty dostosowania, szczególnie w przypadku, gdy wyznaczana granica nieruchomości przebiega wzdłuż rzek, potoków oraz terenów zadrzewionych lub zakrzewionych. W pracy przedstawiono trzy przykłady, które potwierdzają słuszność przyjętych założeń dotyczących zastosowania transformacji z warunkami. Jeden z nich przedstawia fragment sprawy sądowej, w której na podstawie przyjętej metody została ustalona granica nieruchomości z błędem akceptowanym przez obydwie strony.Item type:Article, Access status: Open Access , Determination of coefficient of usefulness of former Austrian cadastre documentation for legal-surveying works in Poland(2009) Hanus, PawełPrace zmierzające do określenia granic prawnych nieruchomości mają zazwyczaj charakter geodezyjno-prawny. Należą do nich podziały nieruchomości, rozgraniczenia nieruchomości, a także niejednokrotnie prace związane z regulacją stanu prawnego nieruchomości. Wykonywanie prac o takim charakterze na terenie Polski południowo-wschodniej wymaga od wykonawcy wykorzystania materiałów archiwalnych katastru austriackiego. Artykuł przedstawia propozycję określenia współczynnika przydatności tych materiałów, a w szczególności map katastru byłego zaboru austriackiego. W artykule na podstawie przyjętych założeń skonstruowano wzory zmierzające do określenia takiego współczynnika, podano propozycje szacowania dopuszczalnych wartości współczynnika oraz przeprowadzono analizę statystyczną weryfikującą poprawność przyjętych rozwiązań.Item type:Article, Access status: Open Access , Entering parcel boundaries into the Polish register of land and buildings - an analysis of the current state and proposed changes(Wydawnictwa AGH, 2020) Maślanka, JózefThe Polish register of land and buildings (EGiB), also known as the real estate cadastre, is of both a technical and declarative nature, which means that the data resulting from special technical, formal and legal procedures should be precisely entered into the EGiB database and then made available to users without distortions or deficiencies. The subject of this research paper is the analysis of formal, legal and technical problems that occur in the process of entering data on the boundaries of cadastral parcels into EGiB. Based on the legal provisions, subject literature, as well as real cases derived from surveying practice, the author performs a descriptive formal and comparative analysis of cur‑rent legal and technical solutions used to enter boundaries of cadastral parcels into the EGiB database. As a result of these analyses, the author has concluded that the existing legal solutions allow neither full and precise entering of parcel boundaries nor providing users with correct data resulting from the performed surveys and legal works. Defects, difficulties and barriers faced when entering boundary data into the register can lead to the distortion of the relevant information, and thus to the decreased reliability of EGiB. The author's proposal is to introduce into the application schema the concept of the boundary segment, together with appropriate attributes defining the structure of the cadastral database. This would allow the elimination of many existing problems and provide EGiB users with reliable and complete information.Item type:Article, Access status: Open Access , Land-use structure - analysis on example of rural and urban communes in Poland and Ukraine(Wydawnictwa AGH, 2018) Kovališin, Oleksandra Fedorìvna; Buśko, MałgorzataIntensive modernization of the cadastre has been implemented in Poland in recent years. During the modernization procedure, land use was updated as well. Obviously, such an update is also carried out on a regular basis, during individual surveying works associated with the real estate cadastre. The article presents an analysis of land-use changes on examples of urban and rural communes in Poland during the period of 2002-2015 (as well as the situation in this aspect in Ukraine). During the analyzed period in Poland, there were two comprehensive modernizations of the cadastre carried out in the study area. The analysis covered two types of usable land: developed agricultural land (Br) and residential areas (B). These two particular types of land use were selected, as the applicable legal provisions in Poland regulating the principles for assigning land use to a specific group changed significantly. At the same time, radically different real estate tax rates are planned for these types of land use. The problem has become especially important after Poland accession to the European Union. Shortly described essential rules of cadastre system and also the ultimate range of grounds data, which are the base for direct determining amount additional payments for agricultural production. It has been stated, that data contained in cadastre are completely sufficient for the aims demanded for IACS system. Comparing data contained in IACS system, one must state, that data referring to the parcel boundaries, do not yield data coming from the cadastre, and moreover they fulfill suitable criteria showed in relevant regulations. However, they are more update then cadastre data. So, one should use them, in cadastre modernization process.Item type:Article, Access status: Open Access , Porównanie funkcjonowania katastru w Niemczech oraz w warunkach polskich(Wydawnictwa AGH, 2005) Przewięźlikowska, AnnaThe article contains an analysis which allows selecting German federal states with the cadastre system functioning most similarly to the cadastre system in Poland. To achieve this goal the author presents the results of an evaluation of the status of the cadastre system in all sixteen federal states as well as Poland and a comparison of the functioning of the system in individual federal states and Poland. The evaluation and comparison have been conducted in seven predefined categories, on the basis of point weights. As the result of the research two metagroups of attributes have been defined: one comprising the categories in which it is hard to introduce quick changes (general data, organization of the cadastre system, contents of cadastre) and the other the categories in which it is easier to introduce changes (data quality, information flows, informatization level, cadastre usability). On this basis the so called »Best cadastre examples for Poland« have been identified, meaning federal states with relatively high evaluations of the cadastre systems and similar characteristic to the cadastre system in Poland. W celu wyznaczenia obszarów narażonych na dezaktualizację ze względu na działanie wody powierzchniowej wykorzystano fakt, że linia brzegowa traktowana jest jako jeden z tzw. fraktali naturalnych. Aby sprawdzić, czy na poziomie szczegółowości bazy danych katastralnych rzeki zachowują swoje fraktalne właściwości oraz czy te właściwości mogłyby zostać wykorzystane do wykrywania obszarów narażonych na dezaktualizację linii brzegowej, przenalizowano przebieg linii brzegowej oraz zmiany w konfiguracji granic ewidencyjnych działek położonych w ich sąsiedztwie. For the purpose of this article, the cadastral systems of seven European countries - Austria, Bulgaria, Estonia, Spain, Lithuania, Germany and Poland - have been examined, taking into account how detailed is the classification in agricultural and forest areas. The research covered the provisions of legal acts applicable in the researched seven European countries and made available in national languages by the government bodies. The article asks the following three questions: 1) whether the researched countries adopted the same approach to isolating classes of items related to agricultural and forest areas, 2) whether the researched countries feature the same number of classes of items recorded at various levels of detail, 3) what is the percentage of the distinguished item classes of land uses in the agricultural and forest areas in relation to all of the distinguished item classes at all the levels of detail. The conducted research can be used as a material supporting works consisting of the modernization of the functioning of land registration in the real estate cadastre in Poland.Item type:Article, Access status: Open Access , Restoration of boundary markers and the determination of boundary points - proposed amendments to the laws of Poland(Wydawnictwa AGH, 2020) Maślanka, JózefThe article presents proposed amendments to the provisions of the Polish Geodetic and Cartographic Law regarding the restoration of boundary markers and the determination of boundary points of cadastral parcels. The current legal regulations are both insufficient and ambiguous, which results in significant and harmful discrepancies both in the interpretation of the legislation and its application. As a result, the database of the register of land and buildings (EGiB), which keeps the records on the boundaries of cadastral parcels and the attributes of boundary points describing these boundaries, frequently does not correspond to the actual status and is therefore unreliable. Due to the importance of this data, and of the entire EGiB database, to the socio-economic system of the country, this should no longer be tolerated. In this research paper, the author highlights the problems both relating to the legal regulations on the procedure as well as to the content of the database of the register of land and buildings. In both cases, the defects carry consequences that are adverse for the quality of the EGiB data and contribute to the loss of their reliability The specific amendments to the legislation proposed in this article are to prevent the further misinterpretation and misapplication of the current legal provisions and should allow to meet the reasonable expectations and needs of the users of the data contained in the register of land and buildings, especially property owners.Item type:Article, Access status: Open Access , Restoration of boundary markers and the determination of boundary points in the context of the reliability of the register of land and buildings(Wydawnictwa AGH, 2019) Maślanka, JózefThe restoration of boundary markers and the determination of boundary points are substantive technical surveying activities, legally regulated in Poland under Section 6 of the Geodetic and Cartographic Law on the delimitation of real properties. These activities are essential for both the proper functioning of the register of land and buildings (EGiB) as well as from the point of view of the owners who, for various reasons including peaceable possession, want to know the course of the boundaries of their properties and have them physically marked on the ground. According to the author of this research paper, the interpretations of the legal regulations on the restoration of boundary markers and determination of boundary points which have recently appeared in the Polish subject literature and geodetic journals, as well as the solutions applied in surveying practice, arouse considerable doubts and cause markerificant distortion of the data stored in the databases of the register of land and buildings as well as result in misinterpretation and incorrect application of these provisions by land surveyors. The article presents a descriptive formal analysis of the applicable provisions of law and the effects of their application on the quality of this data. The author opposes what is, in his opinion, an unauthorised, broad interpretation of the legal provisions, a consequence of which is the fact that a mere physical monumentation of a boundary point on the ground, performed under a technical procedure, fundamentally changes and increases the legal markerificance of this boundary point.Item type:Article, Access status: Open Access , River bank boundary determination(2010) Bieda, AgnieszkaWater is an element of very hard to control. Being in still movement, permanently alternates its environment. Mostly, it annexes neighbourhood lands in order to give back other ones, which were of its possession, so far. It happens, that it exceeds cadastral boundaries. In case of change of river course, or undermining banks by lake or sea waters and also drifting sediments and creating little islands, beaches and sand-bars, it is possible to determine these changes and, if it necessary to regulate legal status of lands situated close to the river. These operations are called River bank boundary determination. It is delimitation between lands covered by waters and adjacent lands. It is performed by professional surveyor on the basis of delimitation project and accepted by suitable public authorities administration. It needs knowledge of surveying and mapping law regulation, hydrology and hydrography. It also demands high scrupulosity from surveyor. This two-stage procedure, whose purpose is the location of boundaries course, is an important and difficult problem in contemporary surveying. The paper discusses the problems of the administrative procedure, with particular regard to the scope of activities performed by a surveyor, who plays many roles. Among them one can indicate the function of the representative body of the public administration, conducting the proceedings on the real estate delimitation, a specialist in the field of surveying, mediator or quasi-judge, before who boundary settlement can be concluded. It also presents situations where it is acceptable to carry a case of delimitation before a common court. In such proceedings, the surveyor is an expert in the field of surveying, and his opinion is a very important, crucial evidence.Item type:Article, Access status: Open Access , Transformacja map katastralnych byłego zaboru austriackiego(Wydawnictwa AGH, 2005) Hanus, Paweł ; Kremiec, KrzysztofCadastral maps of former Austrian annexation are also used nowadays for various surveying works. These maps are applied, first of all, for the needs of grounds and buildings register (real estate cadastre) modernisation. It is necessary, for performing this process, to create cadastral numerical map, with spatial data gathering by means of direct method. Taking into consideration various reasons, including economical ones, such map may also be created on the base of former cadastral maps, through vectorization process, together with expanding their contents of additional data, coming from surveying reports such as: real estate delimitations, subdivisions, assemblages and condemnations. Numerical map creating on the base of former cadastral map, demands scanning process of such map and then using transformation of raster map to the suitable reference coordinate frame. The authors examined whether the acquisition of data from UAVs can replace field measurements or only support them.
