Considering that the liquidation of surface mines differs from liquidation of underground or borehole mines only the technical, legal and financial problems that refer only to surface mining have been discussed. Presented were trends in reclamation and management of post-mining barrens, evolution of legal regulations on the process of mine liquidation as well as methods and sources of financial support for such undertakings. Shortcomings of the present regulations and insufficient financing have been indicated. Obstacles resulting from incoherent laws and regulations, which make it more difficult to carry out revitalisation processes, are described. The works connected to doing it can only be lead by persons certificated as a mining surveyors with the certificate enacted by President of the State Mining Authority, which persons are, in the majority, graduates of the Department of Mining Geodesy and Environmental Engineering of the Mining and Metallurgy Academy. The activity of mining surveyors is under inspection of mining authorities. On the authorization of directors of district mining authorities the inspection is also lead by inspectors, who has the same certificates. Moreover, the tasks of they include enforcement of duties concerning to land protection (including buildings), resource management, land recultivation as well as manage of post-mining lands. It took place mainly in 2001. Successive fundamental changes appeared in 2007 in connection with new regulations, related to the responsibility for prevention from damages and for reclamation of the environment. Changes will probably be continued in two years provided, the advanced already proposition of soil protection directive, will be accepted. For that reason, in the first part of the present paper, a legal situation valid on the end of September of 2007, while in the second one, the most important directions of appeared changes, have been analysed. However, the remarks related to the introduced changes, have also been taken into account in the first part, as far as the regulations concerning responsibility for environmental damages, have been cancelled by the new ones.Item type:Article, Access status: Open Access , Item type:Article, Access status: Open Access , Składowanie odpadów w górotworze w świetle krajowych regulacji prawnych(2006) Macuda, Jan; Zawisza, LudwikStoring of liquid waste in the rock mass by injecting it to the rock mass through injection wells is both environmentally safe and economically competitive as compared to other utilization methods. However, such activity has to be licensed by a respective minister. The basic legal acts regulating reservoirless waste storage underground, i.e. Geological and Mining Law as well as Environmental Law are discussed in the paper. Economic Activity Law for waste storage in the rock mass is also presented.Item type:Article, Access status: Open Access , Uregulowania prawne i organizacyjne dotyczące zasady TPA (Third Part Access) w sektorze gazowniczym na przykładzie Polski i Wielkiej Brytanii(2006) Kaliski, Maciej; Staśko, Dominik; Trzaskuś-Żak, BeataThis paper presents the legal and organization analysis of TPA (Third Part Access) in the gas distributing business in the Polish market. There is described the situation of introduction of TPA in the Polish gas market and there is also included an analysis of British gas market. In the article there is a description of changes demanded from European Union to be put in action in the Polish gas sector, especially included the transfer and distribution. There is included the regulations of creating gas tariffs in liberated gas market. The paper also shows the possibilities of apostasy of TPA regulated by gas directive. There is presented practical site of introduction of TPA in the Polish gas market taking into consideration investments in process of eliminating barriers. This article also presents experiences of function of liberated British gas market. This market can be an example of possible changes, which can also happen in Polish gas sector in introduction of TPA. The changes can affect: - clients behaviour, - offer of gas companies, - level of prices, - structure of market players, - PGNiG's politics.
