Abstract
W pracy przedstawiono prawne uwarunkowania wykorzystania energetyki geotermalnej, z podziałem na poszczególne akty prawne obowiązujące w Polsce na listopad 2017 r. Tematyka ta zawarta jest w wielu ustawach, więc zwłaszcza z perspektywy przedsiębiorców może wydawać się skomplikowana. Omówiono systemy wsparcia energetyki geotermalnej w postaci programów Narodowego Funduszu Ochrony Środowiska i Gospodarki Wodnej oraz ich rzeczywiste efekty. W związku z tym działaniem można wyróżnić wiele planowanych inwestycji, które otrzymały dofinansowanie i są obecnie w trakcie realizacji. Dokonano zestawienia podstawowych parametrów projektów geotermalnych z którego wynika realny rozwój energetyki geotermalnej w Polsce. Mając na uwadze wcześniej omówione aspekty prawne opracowano etapy formalno-prawne związane z powstawaniem ciepłowni geotermalnej w postaci schematu oraz omówienia krok po kroku wszystkich procedur związanych z tym przedsięwzięciem. Celem tej analizy jest nakreślenie przewodnika po zagadnieniach formalno-prawnych w instalacjach geotermalnych.
The paper presents the legal conditions for the use of geothermal energy, divided into individual laws in Poland in November 2017. This subject is contained in many laws, so espe-cially from the perspective of investors may seem complicated. The next chapter refers to the systems of financial support for geothermal energy in the form of programs of National Fund for Environmental Protection and Water Management and their actual effects. This programs have connection with many planned investments, which have received bailout are currently being implemented. A comparison of the basic parameters of geothermal projects shows the real development of geothermal energy in Poland. Formal and legal stages related to the establishment of a geothermal heating plant were created based on a laws in the form of a diagram and shows step by step all the administrative procedures. The purpose of this analysis is to create a guidebook about formal and legal issues in geothermal installations.
