Prawne aspekty rozwoju energetyki wiatrowej w Polsce

Abstract

Celem pracy jest określenie wpływu najnowszych aktów prawnych na rozwój energetyki wiatrowej w Polsce. Szczegółowej analizie poddano dwie, najnowsze ustawy dotyczące tego sektora: ustawę z dnia 20 maja 2016 roku o inwestycjach w zakresie elektrowni wiatrowych (Dz. U. 2016 poz. 961) oraz ustawę z dnia 20 lutego 2015 roku o odnawialnych źródłach energii (Dz.U. 2015 poz. 478 z późn. zm.). W pracy omówiono ewentualne zagrożenia dla branży wiatrowej spowodowane wprowadzeniem nowego, aukcyjnego systemu wsparcia OZE. Przeanalizowano nowe przepisy regulujące lokalizację turbin wiatrowych oraz wynikające z nich konsekwencje. Opisano również jak nowa definicja budowli może wpłynąć na opłacalność inwestycji wiatrowych.

The purpose of this thesis is to determine the impact of the recent legislation on wind energy development in Poland. The two latest laws for this sector were analyzed in detail: Act of 20 May 2016 on Wind Energy Investments (Journal of Laws of 2016, Item 691) and Act of 20 February 2015 on Renewable Energy Sources (Journal of Laws of 2015, Item 478 as amended). This thesis discusses possible risk for the wind industry caused by implementation of the new RES support scheme. Moreover, it analyzes new regulations concerning the localization of wind turbines and its consequences. The thesis also describes how a new definition of construction may affect on profitability of the investments.
