Regulacja prawna w zakresie budowy i eksploatacji linii bezpośrednich a wspieranie rozwoju energetyki rozproszonej w Polsce

Abstract

Przedmiotem rozważań podjętych w artykule jest analiza prawnych uwarunkowań budowy linii bezpośrednich na gruncie prawa krajowego i prawa Unii Europejskiej, w tym ocena projektowanych regulacji w tym zakresie przedstawionych w zmodyfikowanym Projekcie ustawy o zmianie ustawy - Prawo energetyczne oraz niektórych innych ustaw (numer wykazu RCL UC74 w wersji z dnia 17 września 2022 r.). Punktem wyjścia i podstawą podjętych rozważań są wnioski płynące ze Strategii rozwoju energetyki rozproszonej w Polsce do 2040 roku opracowanej w ramach projektu pt. «Rozwój energetyki rozproszonej w klastrach energii (KlastER)», w której jako jedno z istotnych działań służących promowaniu rozwoju energetyki rozproszonej w Polsce wskazano wdrożenie przepisów ułatwiających realizację linii bezpośrednich.

The subject of the considerations in the article is the analysis of the legal conditions relating to the construction of the so-called «direct lines» under national and European Union law, including the assessment of the proposed regulations in this area, presented in the modified Draft Act amending the Energy Law and certain other acts (RCL UC74 list number in the version of 17/09/2022). The starting point and the basis for the considerations are the conclusions of the Strategy for the development of distributed energy in Poland until 2040 developed as part of the project entitled «Development of distributed energy in energy clusters (KlastER)», in which the implementation of regulations facilitating the construction of direct lines was indicated as one of the important activities to promote the development of distributed energy in Poland.
