Spatial planning in localities with special historic values on examples of Poland and Slovakia

One of the objectives of spatial planning policy is the protection of cultural heritage and historical monuments. Since this objective is necessary to be included it in planning documents, it means that spatial planning procedures shall comprise actions associated with the conscious shaping of cultural landscapes and protection of historical objects. Nevertheless, it is believed that these possibilities are not sufficiently used in Polish planning documents. This paper aims to compare the spatial planning systems found in Poland and Slovakia, with a particular emphasis on the conditions that must be taken into account when creating planning documents in historic localities. An analysis of sample documentation prepared for localities with special historical values (Lanckorona in Poland and Levoča in Slovakia) allowed the authors to conclude that local development plans in Slovakia contain fewer details related to the protection of cultural values and monuments than those adopted in Poland. This is a consequence of the fact that the only institution to evaluate this issue in Slovakia is the provincial conservator.

Analysis of legal regulations and proposed changes in definition of contour of building in real estate cadastre

This paper analyzes the legal regulations related to cartography and surveying with regard to the building structures entered into the real estate cadastral database. Particular attention has been paid to the contour of a building structure in the register of land and buildings, and to one of the descriptive attributes - the development area. Under the current laws, the development area results directly from the contour of a building structure. The thesis of this paper is that the current manner of defining the contour of a building and the resulting development area do not reflect the factual status of the building in the field. In order to verify the above thesis, examples of various building structures have been provided that reveal flaws in the definitions. The result is a lack of uniformity in the collected cadastral data in the database of the real estate cadastre of Poland. The consequences of the definitions that are currently binding also include limited possibilities when using real estate cadastral data for economic and spatial planning as well as assessing taxes and benefits. Based on an analysis of the current legal acts and examples of the existing building structures, the author formulated proposals for a definition of the contour of a building structure and its development area.

Concept of municipality geoportal - selected legal and administrative issues

The entry into force of the INSPIRE Directive (Infrastructure for Spatial Information in Europe) has contributed to the progressive building of spatial data infrastructures in the countries of the European Union. Laws on spatial information infrastructure require local government to create and share spatial data. The result of the INSPIRE Directive in Polish legislation is the adoption of the law of March 4, 2010, about spatial information infrastructure by the Polish Government. This act contained the principles of creation and use of spatial data infrastructure. The presented work consists of selected legal regulations and administrative provisions relating to the conduct of a municipality's geoportals. As an example, the geoportal prepared for the Tomice municipality has been presented. To prepare the thematic layers, QGIS software based on the Open Source License was used. Several thematic layers were prepared based on the data made available by the municipality, the data obtained from a national geoportal (www.geoportal.gov.pl), and the General Directorate for Environmental Protection as well as materials developed during the many years of cooperation with the municipality. The process of portal assumptions was made on the basis of Geoxa software. Geoportals can be regarded as tools that are valuable sources of information for various consumers - from the government to individual users. They allow for quick and transparent access to diverse spatial data at the same time based on detailed and reliable sources.

Land-use structure - analysis on example of rural and urban communes in Poland and Ukraine

Intensive modernization of the cadastre has been implemented in Poland in recent years. During the modernization procedure, land use was updated as well. Obviously, such an update is also carried out on a regular basis, during individual surveying works associated with the real estate cadastre. The article presents an analysis of land-use changes on examples of urban and rural communes in Poland during the period of 2002-2015 (as well as the situation in this aspect in Ukraine). During the analyzed period in Poland, there were two comprehensive modernizations of the cadastre carried out in the study area. The analysis covered two types of usable land: developed agricultural land (Br) and residential areas (B). These two particular types of land use were selected, as the applicable legal provisions in Poland regulating the principles for assigning land use to a specific group changed significantly. At the same time, radically different real estate tax rates are planned for these types of land use. The study also analyzes the changes in the communes' receipts from the taxes that are imposed on the owners of land due to the update of the cadastral survey related to the land-use changes.

Practical problems of implementing selected procedures determining course of borders

A large part of the surveying work reported to geodetic and cartography documentation centers are those that, in the end, result in the determination of a border in a field. Until the amendment of the regulation on the Land and Buildings Register, the determination of the borders of individual land parcels was possible only due to acting on the basis of the Geodetic and Cartographic Law. Currently, it is possible to use the procedure for determining the course of the borders of plots performed on behalf of private entities for the purpose of updating the Land and Buildings Register. Determination of the course of the boundaries in a field is also possible on the basis of the performed tasks of determining the border points previously disclosed in the land register or the resumption of border marks. This article analyzes geodetic studies based on Art. 39 of the Geodetic and Cartographic Law, and in accordance with § 39 of the Regulation on the Land and Buildings Register made for the purpose of updating the Land and Buildings Register. On the basis of the analysis, geodetic and legal problems were identified, which are caused by the imprecise regulations encountered by the contractors while carrying out activities aimed at defining the borderline of the field. The author also analyzes the materials that, in light of the binding legal provisions, may serve as a basis for carrying out the renewal of border marks, setting border points, and determining the course of borders.
