Analysis of data consistency between land and buildings registry and land and mortgage register in order to create real estate cadastre

Abstract

Przedmiotem artykułu jest analiza wzajemnych relacji pomiędzy systemem ksiąg wieczystych (KW) oraz ewidencją gruntów i budynków (EGiB), pełniącą rolę katastru nieruchomości w Polsce. KW jest systemem rejestrującym dane o charakterze prawnym dotyczące nieruchomości, a EGiB jest systemem rejestrującym dane faktyczne o działce. Dane z obu systemów stanowią informację katastralną. Systemy te są zarządzane przez odrębne organy i mają różne zasięgi terytorialne. EGiB koncentruje się w ramach powiatu, KW natomiast zarządzane jest przez sądy rejonowe. Rejon oddziaływania miejscowego sądu rejonowego nie pokrywa się z obszarem powiatu. Zakres analizy obejmuje zarówno dane podmiotowe, jak i przedmiotowe wybranej losowo grupy nieruchomości. Obszar badań pokrywa się z rejonem oddziaływania Wydziału Ksiąg Wieczystych Sądu Rejonowego w Stalowej Woli oraz Starostwa Powiatowego w tym samym mieście. Ocenę przepływu informacji przestrzennej i prawnej pomiędzy systemami EGiB oraz KW przeprowadzono, biorąc pod uwagę obiekty wiodące w obydwu systemach. Obiektem wiodącym w systemie EGiB jest działka gruntu, zaś obiektem wiodącym w systemie KW jest nieruchomość gruntowa w znaczeniu wieczystoksięgowym. Analiza przepływu informacji pomiędzy badanymi systemami wykazała szereg istotnych błędów. Autorka weryfikuje je oraz poszukuje rozwiązań zaistniałego problemu.

The object of this study is to investigate the mutual relationship between Land and Mortgage Registers System (KW) and Land and Buildings Registry (EGiB), which acts as a real estate cadastre in Poland (KN). KW is a system recording data of a legal nature relating to real estate, EGiB is a system recording actual data concerning a plot. Data from the both systems constitute a cadastral information. These institutions are managed by separate authorities and have different territorial ranges. EGiB concentrates within the district, while KW is managed by the district courts. The region of influence of the local district court does not coincide with the district area. The scope of the analysis includes both subjective and objective data for a randomly chosen group of real estates. The study area overlaps with the area of influence of the District Court Department of Land and Mortgage Registers in Stalowa Wola and District Office in the same town. The evaluation of the flow of spatial and legal information between EGiB and KW systems was made in the scope of the objects leading in both systems. The leading object in the EGiB system is a plot of land, while the leading object in the KW system is a land property in terms of Land and Mortgage Registers. The analysis of the flow of information between the two systems revealed a number of significant errors. The author verifies them and is seeking ways to solutions of the problem.
