Specific issues referring to the real estate expropriation

Abstract

W artykule przedstawiono szczególne powiązania problemu wywłaszczania nieruchomości z przepisami innych ustaw i zasadami stosowania prawa administracyjnego. Autorkom zależało na pokazaniu, iż nie jest to samodzielna instytucja prawna i interpretacja przepisów musi pozostawać w ścisłym związku z rozwojem wiedzy prawniczej oraz geodezyjnej. Równie ważne jest uwzględnianie powstających nowych problemów nabywania nieruchomości na cele publiczne i dostosowanie wykładni do obecnych potrzeb gospodarczych. Stąd zwrócenie uwagi na szeroki zakres instytucji wywłaszczania nieruchomości, jej ścisłe powiązania z prawem cywilnym, planowaniem przestrzennym i kodeksem postępowania administracyjnego. The authors present in detail the connections between the problem of real estate expropriation and the regulations of other legal acts and principles of the application of administrative law. The authors wanted to show that real estate expropriation is not a separate legal entity and that the interpretation of regulations must strictly comply with the development of legal and geodetic knowledge. It is equally important to consider newly appearing problems of getting real estates for public purposes and adjusting the statutory interpretation to present economic needs. Thus the attention was paid at the wide range of the institution of real estate expropriation, its tight link with civil law, spatial planning and the code of administrative procedures.
